Code of Ethics and Conduct of the Members of the National Assembly of Québec

The Code of ethics and conduct of the Members of the National Assembly (S.Q. 2010, c. 30 (PDF, 1 MB) was unanimously adopted by the National Assembly on December 3, 2010. The provisions contained in the Code came into force gradually beginning on December 8, 2010; since January 1, 2012, all sections of the Code are in force.

The Code

  • states the values and ethical principles of the National Assembly;
  • establishes the rules of conduct to be observed by Members and Cabinet Ministers;
  • determines the manner in which these rules will be monitored and enforced.

The Ethics Commissioner is responsible for the administration of the Code.

Regulation Respecting the Rules of Conduct Applicable to the Office Staff of Ministers

The Regulation respecting the rules of conduct applicable to the office staff of ministers (Gazette officielle du Québec, March 27, 2013, page 776) was adopted by the Ethics Commissioner on March 15, 2013. This Regulation comes into force on April 30, 2013.

This Regulation

  • refers to the values of the National Assembly and the ethical principles the office staff of ministers must adhere to;
  • establishes the rules of conduct to be observed by the office staff of ministers; and
  • determines the manner in which these rules will be monitored and enforced.

The Ethics Commissioner is responsible for the administration of this Regulation.

Rules of Conduct Applicable to the Staff of Members and House Officers of the National Assembly

The rules of conduct applicable to the staff of Members and House officers of the National Assembly were adopted by the Office of the National Assembly, in accordance with section 124.3 of the Act respecting the National Assembly (c. A-23.1), on March 21, 2013 (decision 1690). These rules come into force on April 30, 2013.

These rules

  • refer to the values of the National Assembly and the ethical principles the staff of Members and House officers of the National Assembly must adhere to;
  • establishes the rules of conduct to be observed by the staff of Members and House officers of the National Assembly; and
  • determines the manner in which these rules will be monitored and enforced.

 The Ethics Commissioner is responsible for the administration of these rules.

Definition of Public Body

Section 5 of the Code of ethics and conduct of the Members of the National Assembly refers to the Auditor General Act (R.S.Q., chapter V-5.01) in defining the term "public body". The annual performance report published by the Auditor General lists the agencies and enterprises covered by sections 4 and 5 of that Act.
