INQUIRY REPORTS

Following an inquiry on a Member of the National Assembly, the Ethics Commissioner must immediately submit a report to the President of the National Assembly including the reasons for his or her conclusions and recommendations. A copy of the report must also be given to the Member under inquiry and to the leader of the authorized party to which the Member belongs.

REPORTS ON THE IMPLEMENTATION OF THE CODE

The Commissioner must submit a report on the implementation of the provisions of the Code of ethics and conduct of the Members of the National Assembly every five years. This report is tabled at the National Assembly and reviewed by the relevant parliamentary committee. The next report on the implementation of the Code must be submitted on January 1, 2025, at the latest.

Episode 1 – The Code in Times of Pandemic (Pilot)

In this pilot project recorded in July 2021, Commissioner Ariane Mignolet and two lawyers and members of her team, François Corriveau and Caroline Le Breton-Prévost, discuss the challenges they faced at the beginning of the COVID-19 pandemic regarding the application of certain provisions of the Code of ethics and conduct of the Members of the National Assembly.

Episode 2 – Institutions for the Public Sector Integrity

Commissioner Ariane Mignolet meets with the Commissioner of Lobbying Me Jean-François Routhier. They discuss the mission of their respective institutions and how their mandate and roles promote public integrity for the benefit of citizens.

Episode 3 – The Advisory Opinions of the Commissioner

Members of the National Assembly may request advice from the Commissioner on any matter concerning their ethical obligations. They are provided in a preventive manner and constitute an important part of the support offered to elected officials in the compliance with their Code of Ethics and Professional Conduct. Commissioner Ariane Mignolet discusses it with two prevention lawyers, Me François Corriveau and Me Geneviève Geneau.

Episode 4 – The Inquiry Process

Under the Code of ethics and conduct of the Members of the National Assembly, the Commissioner has the power to investigate the conduct of parliamentarians in matters of ethics and professional conduct. Commissioner Ariane Mignolet discusses the different stages of the inquiry process with two lawyers from her team, Me François Corriveau and Me Pascal Lévesque.

Episode 5 – The Collaboration with Networks

Collaboration with other entities having a role similar to that of the Commissioner is a valuable means of sharing experience and exchanging good practices. Commissioner Ariane Mignolet and Me François Corriveau discuss it with the Senate Ethics Officer at the Canadian Senate, Me Pierre Legault and the Conflict of Interest and Ethics Commissioner of Canada, Me Mario Dion. They address two groups: the Canadian Conflict of Interest Network (CCOIN) and the Réseau francophone d’éthique et de déontologie parlementaires (RFEDP).

Episode 6 – The Relationship with Citizens and the Media

One of the roles of the Commissioner is to inform the public of the rules and what they mean for MNAs or the work of their staff. Commissioner Ariane Mignolet discusses how this relationship with citizens and the media translates with Anne-Sophie St-Gelais, Communications and Institutional Relations Adviser, Jordan Mayer, intern at the Commissioner's office, and Me François Corriveau, lawyer for the prevention sector.

Episode 7 – Multiple functions of political staff

The rules applicable to Member staff do not specifically address multiple functions. However, members of the political staff must respect certain specific rules relating to conflicts of interest, attendance and the use of State goods and services. Commissioner Ariane Mignolet discusses the main elements to be taken into consideration in such circumstances with two lawyers for the prevention sector, Me Nathalie Lachance and Me François Corriveau.

Episode 8 – Bill 48

The Code of ethics and conduct for Members of the National Assembly was instituted with the adoption of Bill 48 in December 2010. Several years of reflection, work and discussions have led to the Code as it stands today. Commissioner Ariane Mignolet and Me François Corriveau discuss it with Mr. Louis Sormany, former Deputy Secretary for Ethics and Legislation at the Ministère du Conseil exécutif.

Episode 9 – Adoption of the Code: historical and social perspectives

Commissioner Ariane Mignolet and Me François Corriveau dive back into the context surrounding the adoption of the Code of ethics and conduct of the Members of the National Assembly with Mr. Denis Saint-Martin, Professor in the Department of Political Science at Université de Montréal. They address the historical and social perspectives of this adoption as well as the emergence of parliamentary ethics and professional conduct elsewhere in the world.

Episode 10 – Post-mandat rules

A member of the Conseil exécutif who has ceased to exercise his functions as such must comply with certain post-mandat rules under the Code of ethics and conduct of the Members of the National Assembly and the Lobbying transparency and ethics act. Certain prohibitions linked to these rules are applicable for a period of two years, while others apply without a time limit. Commissioner Ariane Mignolet and Me François Corriveau disuss these rules with the Lobbyists Commissioner, Me Jean-François Routhier.

Episode 11 – What to know before running in a provincial election

This episode aims to inform candidates running in provincial elections of the ethical principles and obligations that they will have to respect if they are elected and of the impact that these could have on them and on their family. Commissioner Ariane Mignolet and two lawyers from her team, Me Élodie Gagné-Lafrance and Me François Corriveau, briefly discuss the main provisions of the Code of ethics and conduct of the Members of the National Assembly.
